Plan International Canada Inc. (CNO) Media Bank Terms and Conditions
1. This site is owned and operated by Plan International Canada, Inc. (“Plan Canada”). All images, films, stories, publications and other related materials in any medium furnished for use on this site, including related text, captions or information (collectively, “Materials”) are owned by Plan Canada or by our image providers.
2. In order to download / upload Material from the Plan Canada Media Bank you must comply with the following terms and conditions of use:
i. Materials may only be used for Plan Canada programs or activities (“Purpose”) and not for personal use.
ii. Materials must always be credited as specified in the Material details.
iii. Materials should not be altered or manipulated, added to, or have any part deleted in ways that impact negatively on the dignity, privacy or anonymity of the individuals depicted in the Materials.
iv. Where the creators or data subjects have placed additional restrictions on use of their Material, this will be recorded in the resource details accompanying the Material. You must read the resource details thoroughly and ensure that any additional restrictions on use are adhered to.
v. No Materials may be used in a manner that could cause risk to any of the data subjects depicted or damage to Plan Canada’s reputation. If requested by the Plan Canada Media Bank Digital Librarian or Safeguarding Focal Point/Safeguarding Lead, you agree to stop using the Materials.
vi. Users must protect and respect the identity and privacy of individuals shown in the Materials who have a reasonable expectation of anonymity. This would exclude individuals with a public identity.
vii. False names are sometimes used for individuals in the Media Bank; this should be stated, as appropriate.
viii. You are only authorised to publish Materials for the next 6 months; you must not publish any Material after 6 months without confirming prior to each use that the Material remains available for use in the Media Bank. Unless used in a publication, in which case a copy of the publication may be saved, you must delete Materials downloaded from the Media Bank once such Material is removed from the Media Bank.
ix. Users have a legal and moral obligation to ensure that information published is accurate and up to date. If notified that information you hold is inaccurate or outdated, you must amend the information as required. Prior to using Material in a publication, you must check the Media Bank to make sure that the information you hold remains accurate and up-to-date.
x. You may not store, duplicate or re-purpose the Materials except to carry out the Purpose.
xi. Prior to sharing any Materials with a third party, you must ensure: (i) appropriate vetting of the third party; and (ii) execution by the third party of the Plan Canada Media Bank Third Party Access and Use Agreement (Ask the Digital Librarian for more information
xii. If requested by the Media Bank Digital Librarian, you will delete any specified Material.
xiii. Prior to sharing any Materials with other Plan Canada employees, you shall confirm that they have accepted these terms and conditions through the Media Bank.
xiv. If you are submitting Material to the Media Bank, you hereby confirm that:
(i) consent was obtained from the data subject and such consent was informed, voluntary, specific and unambiguous;
the consent form is being stored by the applicable Plan Canada office and will be made available promptly upon request by the Media Bank Digital Librarian.;
(ii) you have entered any restrictions on use in the resources accompanying the Material;
(iii) if a third party was involved in gathering the Material, that individual obtained consent from the data subject and such consent was informed, voluntary, specific and unambiguous; and
(iv) if a third party was involved in gathering the Material, Plan Canada has a licence to use the Material for the purposes listed in the resources alongside the Material;
(v) the Digital Librarian may follow up with you to confirm that these conditions have been met. xvii. For all external media use
(i) No more than 3 photographs by the same photographer may be used in one piece without prior consent from the Media Bank Digital Librarian.
(ii) Photographs must be credited correctly.
(iii) There must be a direct mention of Plan Canada in the piece.
(iv) You must not charge for use of the image.
